Slip/fall on Black Ice!

Please use caution when walking your pet.  I slipped and fell on black ice last year. I still have the remnants of vertigo and I am petrified of falling.  This may sound silly, but carry a flashlight to guide you safely across black ice.

The black ice is shiny and its surface can be more easily discerned by a light shining on it. Ice melts and refreezes. This creates a seriously dangerous condition. Please take photos of the scene, take names and telephone numbers of witnesses.  Call 911! I struck the back of my head and luckily only ended with vertigo versus a cracked skull.  In any event, the property owner has, what is called: a nondelegable duty to keep the premises safe.

This means the property owner, property manager and the snow removal company are all possible defendants; but the owner is most responsible for failure to keep the property safe for the public and tenants and visitors.

TICKING TIMELIMITS TICK TOCK YOUI AUTOMATICALLY LOSE CASE

Connecticut is unique in the world of ticking time limits. In general, all personal injury cases must either be settled or placed into lawsuit within two years of injury or your case is lost forever.

You must also file notice, within shorter periods of time, of a claim for injuries: against a bar (or other server of alcohol) because you, your motorcycle or car was struck by a drunk driver; you were injured because of the negligence of a town, city or state employee; hurt at work (workers' compensation); claim for damages caused by fire; filing under Federal Tort Claims Act; notice of intent to file uninsured or underinsured action...and more.

Well, I have not been diligent of late.  I was simply too busy to even take a moment to post. I apologize to all followers.

My husband and I are personal injury lawyers in CT. We have practiced over 30 years and just about seen it all. I handle the workers' compensation (WC) and social security disability and supplemental security insurance law (SSI). I also manage the office, with the capable assistance of our multilingual staff.

You can check us out on our website www.rubensteinsendy.com; or simply search for our names: Atty Kathrine Sendy and Atty Bruce Rubenstein. We own a small converted house across from Hartford Hospital, in Connecticut (CT).
